Right of Withdrawal for Consumers
If you are a consumer (i.e., a natural person who enters into the contract for purposes which are predominantly outside their trade, business, craft or profession), you have a right of withdrawal in accordance with statutory provisions.
Withdrawal Instructions
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Important for services already commenced: If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated your withdrawal from this contract, in comparison with the full coverage of the contract. Calculation is based on our contractually agreed hourly rate of currently €150/hour for documented working hours.
Premature Expiry of the Right of Withdrawal
The right of withdrawal expires prematurely in the following cases:
- Complete Performance of Services (§ 356 para. 4 BGB): For contracts for the provision of services, the right of withdrawal expires when the trader has fully performed the service and has begun to perform the service only after the consumer has given express consent and has confirmed acknowledgment that the right of withdrawal will be lost upon complete performance of the contract by the trader.
- Digital Content (§ 356 para. 5 BGB): For contracts concerning the supply of digital content not on a tangible medium (e.g., software downloads, source code delivery via Git/Cloud, API access), the right of withdrawal expires when the trader has begun performance of the contract, the consumer has given express consent that the trader begin performance before the withdrawal period expires, the consumer has confirmed knowledge that consent results in loss of the right of withdrawal upon commencement of performance, and the trader has provided the consumer with confirmation thereof.

Context Studios is committed to providing exceptional service and customer satisfaction. Our cancellation policy balances legal requirements with business pragmatism to ensure fair treatment for both parties.
MVP Sprint (4-Week Development)
If you book an MVP Sprint and want us to begin work during the 14-day withdrawal period:
- Express Consent Required: You must explicitly request immediate project commencement
- Acknowledgment of Early Start: You confirm understanding that starting work waives withdrawal rights upon project completion
- Proportional Billing: If you withdraw after work begins, you pay only for completed milestones and deliverables (calculated by sprint week: Week 1 = 25%, Week 2 = 50%, Week 3 = 75%, Week 4 = 100%). This percentage allocation represents a standardized representation of average service progress. The consumer reserves the right to prove that a lower value of services was rendered; we reserve the right to prove a higher value.
- Complete Performance: Once the MVP is fully delivered (typically after 4 weeks), withdrawal rights expire
- Courtesy for Early Completion: If we complete ahead of schedule, your withdrawal period extends until the originally scheduled completion date. This provision constitutes a voluntary courtesy and does not create any legal entitlement.
Custom Software Development (Bespoke Services)
Premature Expiry of Withdrawal Rights: Custom software development projects are subject to special provisions. The right of withdrawal may expire under § 356 para. 4 BGB (upon complete performance of services) or § 312g (2) No. 1 BGB (for bespoke, non-prefabricated products) because:
- Services are not prefabricated and are tailored specifically to your requirements
- Development begins based on your unique specifications and business needs
- Work product is clearly customized to your personal or business requirements
- Business Protection: This protects Context Studios from spec work exploitation
Alternative: Instead of withdrawal, you may negotiate project scope changes or payment terms directly with us before significant development work begins.
Consulting Services (Discovery Calls, Strategy Sessions)
For consulting services, different rules apply:
- Free Discovery Calls: No withdrawal necessary (no contract, no payment)
- Paid Strategy Sessions: Withdrawal right applies until service completion
- Express Consent: If you request immediate scheduling, you acknowledge withdrawal rights expire upon session completion
- No-Show Policy: For no-shows without timely cancellation (at least 24 hours before the scheduled appointment), we reserve the right to charge a cancellation fee in accordance with our Terms & Conditions. The right of withdrawal remains unaffected insofar as legally mandatory.
🛡️ Business Client Exemption (B2B)
Important for Business Clients:
If you are acting as a business (Unternehmer) for commercial or professional purposes, you are NOT entitled to a right of withdrawal under German law (§ 312g (3) BGB).
This includes:
- Companies (GmbH, UG, AG, GbR, OHG, KG, etc.)
- Freelancers and self-employed professionals (Freiberufler)
- Sole proprietors (Einzelunternehmer)
- Anyone ordering for commercial purposes

Note on Consent to Early Commencement of Performance
If you want us to begin performing the service before the expiry of the withdrawal period, we require your express consent. This consent is usually obtained as part of the order confirmation and may read as follows:

☐ I am aware that by giving this consent, I will lose my right of withdrawal after complete performance of the contract.
