Note: contracts with businesses only
Context Studios enters into contracts exclusively with businesses (Unternehmer) within the meaning of Section 14 of the German Civil Code (BGB) (Terms, Section 1). When accepting an offer, you confirm that you are acting as a business. Businesses have no statutory right of withdrawal. The following information is provided only as a precaution in case a contract with a consumer is concluded in an individual case.
Right of Withdrawal for Consumers
If you are a consumer within the meaning of Section 13 BGB (a natural person who concludes the contract for purposes that are predominantly outside their trade, business or profession), you have a right of withdrawal as set out in the following information.

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
End of withdrawal information
Note on compensation: the amount is calculated pro rata on the basis of the total price agreed in the contract (Section 357a (2) BGB).
Early Expiry of the Right of Withdrawal
The right of withdrawal expires early in the following cases:
- Complete performance of the service (Section 356 (4) BGB): For a contract for the provision of services, the right of withdrawal expires when we have fully performed the service and only began performance after you gave your express consent and at the same time confirmed your knowledge that you lose your right of withdrawal once we have fully performed the contract.
- Digital content (Section 356 (5) BGB): For a contract for the supply of digital content not on a tangible medium (e.g. software downloads, source code delivered via Git or cloud), the right of withdrawal expires when we have begun performance after you expressly consented to performance beginning before the end of the withdrawal period, you confirmed your knowledge that your consent means you lose your right of withdrawal once performance begins, and we have provided you with confirmation of the contract on a durable medium.
Termination of Contracts with Businesses
Businesses have no right of withdrawal. Termination is governed by Section 9 of our Terms: you pay for the documented services performed up to termination; no termination fee or lump sum applies.

Consent to Early Performance
We do not enter into contracts with consumers. Should a consumer contract nevertheless be concluded and should you wish performance to begin before the end of the withdrawal period, we would obtain your express consent and confirmation in text form in advance, for example with the following wording:

- I expressly request that Context Studios begin performing the service before the end of the withdrawal period.
- I am aware that I lose my right of withdrawal once Context Studios has fully performed the contract.
- I am aware that, if I withdraw, I must pay a reasonable amount for the services provided up to that point.
For digital content (e.g. software, source code, downloads)
Sample wording
- I expressly consent to Context Studios beginning to supply the digital content before the end of the withdrawal period.
- I am aware that, by giving this consent, I lose my right of withdrawal once performance begins.
- Context Studios will confirm the contract, including this consent and acknowledgement, on a durable medium, e.g. by email (Section 356 (5) BGB).
